Terms and Conditions of our site

All content on this site such as text, graphics, logo's, and images remain the property of OzzieMoto. Any improper use including reproduction, modification, distribution, transmission, republication or display of the content on this website is strictly prohibited.

DISCLAIMER

All prices quoted on this site are subject to change without notice due to market and currency fluctuations, changes in duty, GST and other Government charges. We reserve the right to alter our prices at any time.

INTERNATIONAL CUSTOMERS

We welcome orders from outside Australia, however due to issues relating to GST and freight charges, our website does not provide for transactions from outside Australia. We encourage international customers to email their orders and we will process payment in a real time transaction. Freight, duties, and taxes levied in respective countries will need to be paid by the customer. Australian GST will not apply to orders with a delivery address outside of Australia.

GST

The current rate of Goods and Services tax in 10%, and will be applied to all orders with a delivery address within Australia. This rate may change in the future and is based on Australian Legislation. Prices on our website are inclusive of GST.

TITLE

Title of goods ordered from our site will pass to customer only when full payment is received and cleared.

DELIVERY

Our mode of delivery is via the Standard Australia Post system. Special request for other forms of delivery should be emailed to OzzieMoto, along with payment details. OzzieMoto will process special delivery payment in real time and issue a receipt via return email.

Delivery is usually within a week, but can take up to two weeks. We recommend choosing a delivery address where someone is present to accept the delivery.

RETURNS, REFUNDS, AND REPLACEMENTS

Claims for damaged or faulty goods must be lodged within 24 hours of delivery. Damaged or faulty goods must be returned by the customer within 7 days. Once goods are received by OzzieMoto, we will forward a replacement product to the customer.

OzzieMoto will not refund monies on a product where the customer has changed their preference in any way or form.

Refunds will only be given where there is substantial proof that the product was faulty in its manufacture.

AVAILABILITY OF PRODUCT

All products on our site are supplied subject to availability. We will use our best endeavours to supply the customer with the product they have ordered. On occasion however, goods that are displayed or advertised on our website and purchased by a customer may not be available. If this occurs, we will contact our customer and issue our customer with a refund or credit note for that part of the order that cannot be supplied.

COMMUNICATION

As a condition of purchase from ozziemoto.com.au we reserve the right to email our customers with future promotions and information that we may consider to be of interest to our customers. We respect the right of our customers not to receive this information and if our customers advise that they do not wish to receive this information, we will disable that functionality of their account.

ORDER ACCEPTANCE

Order acceptance and the completion of the contract between OzzieMoto and customer will take place on the dispatch to the customer of the ordered products.

Non-acceptance of an order may be the result of one of the following:

· Our inability to obtain authorization for the customers payment

· The ordered product is unavailable from stock

· The identification of a pricing or product description is incorrect.

We reserve the right to not communicate regarding a transaction for which an authorization was not obtained or if fraudulent activity is suspected or identified.

AUTHORITY TO PURCHASE

By accepting our terms and conditions, you as the customer, acknowledge that you have the authority to enter into a commercial transaction with ozziemoto.com.au. If you are under 18 years of age, you cannot enter into a transaction with ozziemoto.com.au. Commercial employees, purchasing on behalf of a company or business, must have the appropriate company authority to enter into a transaction on the company’s behalf.

PAYMENT OPTIONS

We accept Mastercard and Visa cards. Unfortunately, we cannot accept payment by any other card.

SECURITY of CREDIT CARD PAYMENTS

All transactions on this site are processed using SSL, (Secure Socket Layer), an encryption feature of software built into web browsers preventing access to information exchanged between browser and server by anyone else. This protects the transfer of credit card details to our server. On most P.C’s you will see a padlock symbol at the bottom or top of your browser, indicating that the pages being displayed are under SSL encryption.

LIMITATION OF LIABILITY

In no event shall OzzieMoto be liable for any indirect, special, incidental or consequential damages or loss including but not limited to loss of income, loss of use, loss of data, loss of business or profits howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. To the extent permitted by law, OzzieMoto does not accept any liability for any damage or injury caused by the use or misuse of products purchased from OzzieMoto. To the extent that OzzieMoto may be liable for a breach of condition of the Trade Practices Act 1974 (other than a condition or warranty implied by section 69 of the Act), the maximum aggregate liability for any product supplied to customers whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by the customer to us in respect of the product(s) in question.
